· How can I get a copy of a police report?
An individual directly involved in a case may obtain a copy of a police report by coming into the Centerville Police Department between the hours of 8:00 A.M. and 5:00 P.M. Monday through Friday and filling out a GRAMA form. The Chief approves the requests on an individual basis, depending on the confidentiality of the information enclosed. The cost for a report is $5.00, except for victims of domestic violence. · How can I get fingerprints done?
Centerville residents or people who work in Centerville can come into the Centerville Police Department between the hours of 8:00 A.M. and 5:00 P.M. Monday through Friday and have them done free of charge. Anyone else will be charged $15.00.

· What does the city ordinance say about overnight parking?
Centerville City Code 14-5-101 states that overnight parking is not allowed between November 15th and April 15the. After that, no motor vehicle may be parked on the roadway for more than 48 hours without being moved. Camping vehicles, boats, trailers, buses, etc. cannot be parked on the road for more than 24 hours without being moved, under Centerville City Code 14-5-104. Back to top

You may park your vehicle that is for sale on your private property. You may not park a vehicle that is for sale on someone else's property, including businesses or residences, or upon any highway within Centerville City for the principal purpose of displaying such vehicle for sale, under Centerville City Code 14-5-103. · What are the rules of the road for motorized scooters or gopeds?
State law does not require the scooters to be registered and it is not required to have a driver's license to operate them on the road, however they may not be operated on any road with a speed limit over 25 MPH, nor can they be altered from the original manufacturer's design. They cannot be used by anyone under 16 years of age unless it is under direct supervision of the parent or guardian. Anyone under the age of 18 must have an approved helmet on while operating a motor assisted scooter on a public road. No vehicle, bicycle or device that can be propelled by human power, including scooters, can be operated on a sidewalk. Back to top

· What is the curfew for Centerville?
Curfew for minors under the age of 18 in Centerville City is at 12:00 midnight everyday, under Centerville City Code 13-30-1-02. Some exceptions to this are if you are gainfully employed and going home from work, attending or going home from a function of any school or church, attending or returning home from a lawful entertainment, amusement or commercial activity. PART 13-30-3-00. DISTURBING THE PEACE.
13-30-3-01. NOISE.
(a) General Prohibitions. It is unlawful to:
(1) intentionally disturb the quiet, comfort or repose of any person in his or her dwelling by making unreasonably loud noises, which under the circumstances would disturb a person of average and reasonable sensitivities; or
(2) make unreasonably loud noises with a reckless disregard that the noise is disturbing the quiet, comfort or repose of any person in his or her dwelling, which under the circumstances would disturb a person of average and reasonable sensitivities, after being informed that the noise is having that effect; or
(3) make unreasonably loud noises with the intention of preventing or disrupting a lawful meeting, gathering, business or other lawful activity, which under the circumstances would disturb a person of average and reasonable sensitivities; or
(4) make unreasonably loud noises with a reckless disregard that the noise is preventing or disrupting a lawful meeting, gathering, business or other lawful activity, which under the circumstances would disturb a person of average and reasonable sensitivities, after being informed that the noise is having that effect.
(b) Specific Prohibitions. The following acts are unlawful between the hours of 9:00 p.m. and 6:00 a.m.:
(1) Loading Operations. Loading, unloading, opening or otherwise handling boxes, crates, containers, garbage containers or other objects;
(2) Construction Work. Operating, or causing to be operated, any equipment used in construction, repair, alteration or demolition work on buildings, structures or streets.
(3) Commercial Power Equipment. Operating, or permitting to be operated, any power equipment, in excess of 5 horsepower.
(4) Garbage Collection. The collection of garbage, waste or refuse.
(c) Exemptions.
(1) The restrictions set forth in the preceding two sections do not apply in case of actual emergencies.
(2) Applications for a temporary permit for relief from the foregoing restrictions on the basis of undue hardship may be made to the City. The applicant must explain why no other reasonable alternative is available. Any permit granted by the City Administrator or his or her authorized representative shall contain all conditions upon which the permit has been granted, including but not limited to the effective dates, any time restrictions, location, and any other reasonable requirements to minimize adverse affects upon the surrounding neighborhoods.
(d) Penalty. It is a class C misdemeanor for any person to disturb the peace or quiet of any neighborhood, family or individual in violation of any of the provisions contained in this Section. Back to top

· Is it legal to shoot any of the following items within Centerville City limits? If so, which ones? Airsoft Guns? Paintball Guns? BB Guns? Pellet Guns?
City Ordinance prohibits shooting or discharging any "rifle, gun, pistol, air gun, bean shooter, flipper, slingshot, or other instrument, firearm, or BB gun" within the limits of the city. Exceptions are made for self defense and lawful hunting within certain areas in the north west portion of the city. Many areas of the "Fire Break" road are outside of the city limits, Federal laws prohibit shooting in areas below the upper lake level within Federally owned property. Back to top

· What is Centerville's policy regarding excessive dog barking during daytime and/or nighttime hours? Should a citizen approach his neighbor directly about excessive barking, or start with the authorities?
Talking to your neighbor first is usually the best alternative and may solve the problem while maintaining good relations. Centerville City Code 13-20-29 refers to nuisance animals and reads in part as follows:
A. All persons having custody of animals shall exercise proper care and control of his or her animal (s) in order to prevent them from becoming a nuisance. It shaall be unlawful for any owner or custodian to keep a nuisance animal contrary to the provision of this chapter.
B. An animal shall be deemed to be a nuisance if the animal:
4. Barks, whines, howls, or makes other disturbing noises for an extended period of time;
If it becomes necessary for a complaint to be made to the Police Department or Animal Control, it would be helpful if there were some record such as notes taken on time, date, type of noise and duration of the nuisance. An audio recording may be helpful as well.

· I see that pocket motorcycles can be operated on Centerville streets with speed limits under 25 mph, but what if the pocket motorcycle violates the city noise ordinance? Can that be reported to the police?
Pocket motorcycles or mini motorcycles cannot be legally operated on any roads in the State of Utah. It is hard to enforce though. The confusion is with motor assisted scooters which can be operated on streets 25 MPH or less. Refer to 41-6a-1115 and 41-6a-1117 also refer to definitions 41-6a-102 (29). Back to top

· What are the city ordinances with regards to door-to-door sales persons or solicitors?
Unfortunately there are no current restrictions. A lawsuit filed by a door to door vacuum company against numersous Utah cities forced a repeal of our ordinance. If you do not want solicitors, it is best to post a "No Solicitation" sign near your door. Then no uninvited solicitors may come to you door, or it is a trespass. Back to top

· Firecrackers late at night
Firecrackers are illegal in the state of Utah , they cannot be possessed or discharged at any time. The discharge would also constitute a disturbance of the peace. Back to top

· Does Utah honor Idaho concealed weapon permits?
Utah honors all out of state concealed weapon permits under 76-10-523 (2). Anyone who has a permit issued by another state or county may carry a concealed weapon persuant to the applicable laws in our state in the same way the Utah State CCW permit allows. Back to top

· Is there a noise ordinance that prohibits the use of car horns as doorbells? Several of my neighbors have visitors that use their car horns to notify the occupants inside that they are outside waiting for them. Normal honking occurs midday, but occasionally I have heard horns being honked as early as 6 am and sometimes after 11 pm. This practice is rude to neighboring homeowners.
There are two laws that can apply to this problem. If the vehicle is on the street then there is a clear violation of law under 41-6a-1625 use of horn for other than reasonably necessary for safe operation. The other situation is a violation of the City's noise ordinance 13-30-3-00 "make unreasonable loud noises with a reckless disregard that the noise is disturbing the quiet, comfort, or repose of any person in his or her dwelling, which under the circumstances would disturb a person of average and reasonable sensitivities, after being informed that the noise is having that effect"
Under the city code some kind of notification should be made to the home owner that the noise is unreasonable.

· Is it illegal in any way to Toilet Paper somebodys house?
Toilet Papering someone's house can be risky. If the receiving property owner disapproves and calls police it will be treated and investigated as a crime. Possible charges could include: Littering, Criminal Mischief and Disorderly Conduct. If the complainant wishes to, they can pursue charges and those responsible will be charged with the appropriate code violation. These generally would be charged as either a Class C or Class B Misdemeanor. We have investigated cases in the past that have been ongoing and malicious toilet papering of a home. If you are going to toilet paper someone's house make sure that they have a good sense of humor, and you may want to help them clean it up! Back to top
