NOTICE IS HEREBY GIVEN THAT THE CENTERVILLE CITY COUNCIL WILL HOLD ITS REGULAR PUBLIC MEETING AT 7:00 P.M. ON TUESDAY, APRIL 18, 2006 AT THE CENTERVILLE CITY COMMUNITY CENTER AND CITY HALL COUNCIL CHAMBERS, 250 NORTH MAIN STREET, CENTERVILLE, UTAH. THE AGENDA IS SHOWN BELOW.

Centerville City, in compliance with the Americans With Disabilities Act, provides accommodations and auxiliary communicative aids and services for all those citizens in need of assistance, including hearing devices. Persons requesting these accommodations for City-sponsored public meetings, services, programs, or events should call Blaine Lutz, Centerville Finance Director, at 295-3477, giving at least 24 hours notice prior to the meeting.

A notebook containing supporting materials for the business agenda items is available for public inspection and review at City Hall and will be available for review at the meeting. Upon request, a citizen may obtain (without charge) the City Manager’s memo summarizing the agenda business., or may read this memo on the City’s website: www:centervilleut.net.

E.1. Legacy Parkway Presentation - Joe Walker, a public relations manager for the Legacy Parkway Project, has asked for time on the Council’s agenda to make a formal presentation. Similar presentations are being made to the city councils of other South Davis cities. Even though the Legacy Parkway team has met with City staff and other City officials during the past several months, this will be a formal progress report to the City Council and Centerville citizens. I believe the report will include an overview of the entire length of the project, but will also focus on the Centerville segment more specifically.

E.2. Continuation of Hearing - Mark’s Auto Business License - At your last meeting, you conducted a hearing on the denial of a business license for Mark’s Auto, located in the Business Park, west of I-15. At that hearing, Mark Clark, the owner, submitted evidence that he had met some of the requirements for that license. The Council continued the hearing until April 18 to allow Mr. Clark additional time to complete the remaining requirements. Since Cory Snyder has been out of town this entire week, I do not have a report from him on whether Mr. Clark has satisfied the remaining requirements. However, Cory will be at the Council meeting to respond to questions regarding Mr. Clark’s compliance.

E.3. Amended Lot 16 of Evergreen Business Park Subdivision - The Planning Commission has recommended approval of an amended plat for this subdivision, which vacates Lot 16 from the existing subdivision and divides it into two lots. The Council must conduct a public hearing on the proposed vacation of Lot 16 from the existing subdivision before proceeding with approval of the final plat for Amended Lot 16.

E.4. Huffaker Appeal - Todd and Maureen Huffaker have appealed the Zoning Administrator’s decision affecting a parcel they own at approximately 583 North Main Street. Cory Snyder has refused to issue any development permits for this parcel because it was not created in compliance with the City’s Ordinances. Please see the enclosed report from Cory explaining his decision as well as all the correspondence between Cory and Mr. and Mrs. Huffaker, including the Huffaker’s final submittal to the City Council for this appeal hearing.

E.5. Whitaker Home Museum Grant Application - The City Council is aware this matter has been pending for several months. The Historic Sites Committee recommended in the fall of 2005 a grant application that would fund a feasibility study/master preservation plan for the Whitaker Museum building. Due to controversy at that time, Mayor Deamer directed the Historic Sites Committee to hold a public forum, which was held on March 14, 2006. The Committee is now coming back to the Council with its recommendation to proceed with the feasibility study. This would be funded by grants from both the state and federal government. The grants would be used for the feasibility study and preparation of the master preservation plan, not for any of the improvements that might be recommended.

E.6. Parks and Trails
a. Bid award for northeast park - Three bids were received for Phase 1. The low bidder is Hughes General Contracting in the amount of $248,491. The Engineer’s estimate was $225,000. Staff recommend the Council award this bid.
b. Porter Lane Parkway project - I will update the Council on this project.

E.7. Quarterly Financial Report - Blaine Lutz has prepared the enclosed financial summary for the first nine months of the current fiscal year. The report is very positive, including revenues exceeding budget estimates.

E.8. Summary Action Calendar
a. Resolution No. 2006-14 - The time has come to terminate the interlocal agreement which created the South Davis Fire District, the forerunner of the current South Davis Metro Fire Agency.
b. Prosecutor Services Agreement - Ryan Perkins, a County prosecutor, is taking the place of Brian Namba, a former County prosecutor who has resigned from the County and is now in private practice. Mr. Perkins will provide prosecutor services in our Justice Court, along with two other County prosecutors on an as-needed basis at $60.00 an hour. This arrangement has been very beneficial and cost effective for Centerville City.

E.9. UTOPIA Progress Report - Councilman Paul Cutler, the City’s representative on the UTOPIA Board, will show the power point presentation that was shown to city officials in St. George last week.

E.10. Minutes - The minutes to be approved are enclosed.

E.11. Mayor’s Report - I assume the Mayor will report on a few matters.

E.12. City Manager’s Report - I will report on several matters. One of those is a recommendation to ask Davis County to adopt regulations protecting groundwater sources outside city limits. This relates to the second item under the City Manager’s report, an update on the Porcupine Ridge Pipeline Project. Since I have been gone much of the past two weeks, I have not talked with a representative of Holly Energy Partners; however, there has been an attempt by one of their representatives to reach me while I was gone.

E.13. Miscellaneous Business - The draft of the next City newsletter is enclosed for your review and comments.

E.14 Closed Meeting - This afternoon I received a call from Earl Tingey regarding the City’s offer to purchase property for the expansion of Community Park. The Tingeys are interested in the City’s offer, but there is a related issue I should discuss with the Council in closed meeting.

E.15. Possible Action Following Closed Meeting - The agenda shows the possibility of action following the closed meeting, if pertinent.
