6:00 Open House with Davis County Commissioners - The County Commissioners have requested some time prior to our regular Council meeting to meet with Centerville officials and any citizens who would like to talk with them. Since you will be going into a regular meeting following this open house, a light dinner will be provided for the Council and Commission. The Mayor and I have identified the following possible topics for discussion with the Commissioners as time permits:

• Joint flood control projects
• Disposition of 40 acres owned by County on mountainside
• Transportation issues, including Legacy Parkway frontage road, future improvement of Sheep Road and possibility of 1/4 cent sales tax for transportation projects
• Regional theater for South Davis
• Founders Park lease and Library lease
• County-wide economic development plan

I have enclosed several documents relating to the subjects above behind the work session tab in the notebook.

Regular Council Meeting

D. Commendation and Awards - The Mayor will recognize Police Officer Allen Ackerson and Public Works Director Randy Randall as indicated on the agenda.

F.1. Summary Action Calendar
a. Garbage Collection Contract Extension - Based on direction given by the Council in an earlier meeting, staff have prepared a contract extension with Ace Disposal for garbage collection. The City’s costs will increase under this contract extension; therefore, the City Council needs to discuss the possibility of a garbage collection rate increase during the annual budget process in May and June.
b. Mayor’s appointments to Community Foundation Board - The Mayor is requesting the Council’s consent of the appointment of David Gutke, Scott Marquardt and Harold Yancey to new terms on the Centerville Community Foundation Board of Directors.
c. Professional Services Agreement - I recommend the Council approve an agreement with Brandon Poll, a Deputy County Attorney, for prosecutor services in the Centerville Justice Court. This agreement is identical to that which is already in place for three other Deputy County Attorneys. One of those agreements pertains to Troy Rawlings, who has been elected County Attorney and, therefore, has decided not to continue as a prosecutor in the Centerville Justice Court. Brandon Poll is filling that vacancy.

F.2. Public Hearing re: Historic Sites Committee Ordinance - This public hearing will be continued to the April 17 meeting due to a delay in the Planning Commission’s consideration of this matter. The proposed amendment involves a change in the number of members on the Historic Sites Committee.

F.3. Public Hearing - Rezone of property - The Planning Commission recommends approval of a rezone of 4.66 acres located at the southeast corner of Lund Lane and Main Street, changing the zoning from Agricultural-Low to Residential-Low. This property is owned by the LDS Church and is intended to be the site of a new church building. Churches cannot be built on agriculturally-zoned property, but can be built under a conditional use permit on residentially-zoned property.

F.4. K&R SAMCO Commercial Subdivision - This subdivision was created by a lot split approved by the Planning Commission more than a year ago. Since then a final site plan has been approved by the Planning Commission and a plat prepared for recording; however, the City Council needs to take action pertaining to this matter, including approval of a storm drain impact fee credit, the acceptance of easements and possibly the approval of a final plat. Normally lot splits do not require Council’s approval.

F.5. Park and Recreation Business
a. Facilities Use Agreements - The Ute Football Conference - Viewmont District and the South Davis Soccer Association/ Utah Rush use playing fields at the Centerville Community Park for some of their games. The enclosed agreements set forth the terms and conditions for using these fields.
b. Concessionaire Agreement - For a number of years the City has operated the concessions at Community Park by hiring seasonal employees. I now recommend the City provide this service via a contract with a concessionaire. The proposed contract is enclosed.
c. Bid Awards for Freedom Hills Park Phase 4 - Bids were opened today for construction of Phase 4 (landscaping and irrigation) of the Freedom Hills Park. However, due to concerns about the low bid, staff are not recommending award of this bid, but instead will recommend this project be rebid. The reasons for this recommendation will be explained at the Council meeting.

F.6. Training on Open and Public Meetings Act - This training was postponed from the last regular meeting due to a lack of time.

F.7. Minutes Review - The regular minutes to be approved are enclosed. However, the joint work session minutes will be given to you later.

F.8. Mayor’s Report - At this time I have not identified any subjects for the Mayor, but the agenda shows that possibility.

F.9. City Manager’s Report - I will likely want to report on a few matters.

F.10. Miscellaneous Business - The Bamberger Parkway was constructed within the last year. Unfortunately, due to an oversight, it did not include a handicap ramp connecting the Cedar Springs residential area with the parkway. I believe this oversight should be corrected and recommend the Council authorize staff to accomplish this via a change order with a contractor presently doing work for the City.

F.11. Closed Meeting, if necessary - The agenda shows the possibility of a closed meeting, but at this time, I do not know of a need for one. The Mayor will recommend an appointment to fill a vacancy on the Trails Committee. The Statement of Interest is enclosed for this citizen, but is considered a confidential document until the Council approves this appointment. If desired, the Council can go into closed meeting to discuss this appointment.
