Minutes of the Centerville City Council meeting held Tuesday, September 18, 2007 at 7:00 p.m. in the Centerville City Council Chambers, 250 North Main, Centerville, Utah.

COMMENDATIONS AND AWARDS
Mayor Russell presented David Hirschi with a plaque and dinner certificate for his service on the Planning Commission from June 2005 to September 2007. Mr. Hirschi was commended for his service to the community.
OPEN SESSION
Larry Wright - Mr. Wright asked the Council if they had an opinion regarding whether they should use their legislative power to prohibit the employment of illegal aliens. The Mayor responded by stating that State and Federal laws govern those matters and the Council has not attempted to add to those laws with local ordinances.
SUMMARY ACTION CALENDAR
The Council reviewed items a and b on the Summary Action Calendar. Councilman Allen made a motion to approve items a and b on the Summary Action Calendar. The motion was seconded by Councilman Gutke and passed by unanimous roll-call vote (5-0). Approved were:
a. Termination of Temporary Easement on Lot 301 of Centerville Marketplace Subdivision Phase 3.
b. Bid award to RMT Equipment in the amount of $54,545.00 for a mini-excavator for the Public Works Water Division.
WHITAKER MUSEUM REPORT
Rebekah Barton, Whitaker Museum Board Chair, updated the Council regarding projects the Museum Board has been working on since its inception in March 2007. The Museum Board is in the process of adopting a mission statement, making the museum a community spotlight, expanding educational efforts, and creating community events, such as the Harvest Festival to be held on September 29, 2007. Ms. Barton explained what activities are planned for the Fall Festival. She also updated the Council on future community events the Whitaker Museum is planning. Ms. Barton hopes to have job descriptions for Museum Board members and the Director for the Council to review by the first of the year. Ms. Barton also suggested some building improvements, including a new restroom with ADA accessibility, conversion of an existing porch to use as display area and a new roof sometime next year. The Museum Board will be making these recommendations to the Council later this year.
RECONSIDER APPROVAL OF POWERS SUBDIVISON, LOCATED AT 170 NORTH 200 EAST
Lisa Romney, City Attorney, explained the Powers Subdivision was given final approval by the City Council on January 2, 2007. The final plat must be recorded within six months of final approval, which expired in July 2007. Mr. Powers has had a very difficult time getting his lender to sign the plat or a Consent to Dedicate. He has now obtained Consent to Dedicate and is asking the Council to reconsider the approval so he can record the final plat.
Councilman Allen made a motion to re-approve the final plat for the Powers Subdivision located at 170 North 200 East. The motion was seconded by Councilwoman Lindstrom and passed by unanimous roll-call vote (5-0).
DISCUSS INTERLOCAL AGREEMENT WITH DAVIS COUNTY SCHOOL DISTRICT REGARDING CONTRIBUTION TOWARD TURF AT VIEWMONT HIGH SCHOOL
Steve Thacker, City Manager, asked the Council to review a letter from Paul Waite, Davis County School District, requesting the contribution payment for the new turf at Viewmont High School, explaining the proposed field usage guidelines and the need to update existing Interlocal agreements with the School District and Centerville City. Mr. Waite sent a memo to the City explaining the School District’s intent to review and update the existing Interlocal Agreement between Davis County School District and Centerville City. Mr. Waite is working with Michelle Beus, Legal/Policy Specialist, to review all of the Davis County cities’ interlocal agreements. It is their intent to restructure all of them so one Interlocal Agreement will accommodate each city’s needs. The Council agreed to hold final payment until they could review the new Interlocal agreement to determine how the field scheduling will be coordinated and assure Centerville City will have adequate consideration in this matter.
Mr. Thacker also reviewed with the Council a conceptual analysis of the value Centerville residents will continue to receive from use of the Centerville Junior High School soccer field as an element in the Interlocal Agreement being drafted. Council agreed this analysis provides the justification needed to support the City’s $25,000 contribution towards new turf at Viewmont High School.
AUTHORIZE VOTER INFORMATION PAMPHLET FOR NOVEMBER ELECTION REGARDING RAP TAX ISSUE
Mayor Russell explained the next newsletter includes an article mentioning the possibility of a voter information pamphlet and inviting proponents and opponents of the RAP tax to express their interest by October 5, 2007 if they want to write statements for or against the ballot question. The Council agreed that this was a good idea and noted that there are funds in the Budget to allow for this. The estimated cost of a voter information pamphlet, including printing and postage is $1,800 to $2,000. The Council discussed guidelines for selecting interested writers and selection of a spokesperson for each side. Mr. Thacker reviewed a timeline for written submissions and printing and mailing of the pamphlets. The Council agreed with staff’s recommendations regarding this process.
Councilman Cutler made a motion to authorize up to $2,000 out of the Primary Election Budget (not used this year) for printing and distributing of a voter information pamphlet for the RAP Tax issue. The motion was seconded by Councilman Gutke and passed by unanimous roll-call vote (5-0). The Council will make a final decision, however, at their October 16 meeting, regarding whether to print and mail the pamphlet.
REVIEW PROGRESS ON CITY COUNCIL’S GOALS
Steve Thacker, City Manager, reviewed progress made on Council goals as described in the May 29, 2007 meeting minutes. The Council and Mr. Thacker reviewed various topics and their progress to date. Some of the items discussed included landscaping at Parrish Lane interchange and west to Legacy Parkway, implementation of bike lanes along the Frontage Road and then landscaping on west side of Frontage Road. A community survey was also a priority in the goal setting meeting and this item is in progress and should be completed by the end of the year. Mr. Thacker reviewed other goals which have been completed and assignments he has made to various staff members to follow up on items still to be resolved. Councilman Dellastatious suggested City staff look into implementing a sick leave pool where employees can voluntarily donate a sick day to assist employees during extended illnesses and/or family medical leave. Councilman Allen suggested studying a program that would help new police officers purchase homes in Centerville City by aiding in down payment assistance. He also suggested the Council consider honoring a local teacher quarterly throughout the year.
At 8:55 p.m. the Council took a ten minute break.
MINUTES REVIEW AND ACCEPTANCE
The minutes of the September 4, 2007 City Council meeting were reviewed and amended. Councilman Allen made a motion to approve the minutes as amended. The motion was seconded by Councilwoman Lindstrom and passed by unanimous vote (5-0).
MAYOR’S REPORT
Mayor Russell noted that Wal-Mart has made donations to the City and various other organizations within South Davis County.
Mayor Russell emailed the Council a copy of a letter for their review and input explaining the RDA’s offer to donate land and the possible use of tax increment to build a Performing Arts Center.
Mayor Russell updated the Council on a recent Utah League of Cities and Towns convention he attended. One of the ideas presented at the convention was the need to create public awareness of what types of City services are provided to residents.
Mayor Russell asked the Council if they are interested in updating the City logo/brand. The Council agreed with the Mayor’s suggestion.
September 26, 2007 is the ground breaking ceremony for the new Eaglewood Fire Station.
CITY MANAGER’S REPORT
Steve Thacker, City Manager, used this item on the agenda to provide the Council with backup material for and upcoming work session and review other upcoming calendar items.
