Minutes of the Centerville City Council meeting held Tuesday, December 4, 2007 at 7:00 p.m. in the Centerville City Council Chambers, 250 North Main, Centerville, Utah.

MINUTES REVIEW AND ACCEPTANCE
The minutes of the November 20, 2007 Canvass of Election meeting were reviewed. Councilman Cutler made a motion to approve the minutes. The motion was seconded by Councilman Gutke and passed by unanimous vote (5-0).
The minutes of the November 20, 2007 City Council meeting were reviewed and amended. Councilman Cutler made a motion to approve the minutes as amended. The motion was seconded by Councilman Gutke and passed by unanimous vote (5-0).
SUMMARY ACTION CALENDAR
The Council reviewed items a and b on the Summary Action Calendar. Councilman Allen made a motion to approve items a and b on the Summary Action Calendar. The motion was seconded by Councilwoman Lindstrom and passed by unanimous roll-call vote (5-0). Approved were:
a. Resolution No. 2007-22, establishing Council meeting schedule for 2008.
b. Agreement with US Geological Survey in the amount of $3,625 for maintaining gauging station on Centerville Creek.
PUBLIC HEARING RE: WATER RATE INCREASE – RESOLUTION No. 2007-23
Steve Thacker, City Manager, explained that staff is recommending an increase in culinary water rates to cover operational costs and pay for capital improvements recommended in the water system master plan. This is only the second water rate increase in the past 17 years. The most recent was in 2002, which was committed entirely to capital projects, including an additional well, new storage tank and fluoridation of the water system. It was determined at that time a water rate increase would be needed in approximately five years.
At 7:15 p.m. Mayor Russell opened the public hearing.
Don Youngblood, business park property owner – Mr. Youngblood is not in favor of the water rate increase. The business park does not have access to secondary water for landscaping maintenance and property owners are forced to use culinary water for this purpose. He is concerned that the cost for landscape upkeep will be too high with the proposed increase. Mr. Youngblood presented the Council with a signed petition of other Business Park property owners who also oppose the rate increase. Mr. Youngblood responded to questions from the Council regarding estimated water usage for landscape maintenance.
At 7:25 p.m. with no others wishing to comment, Mayor Russell closed the public hearing.
The Council discussed other secondary water sources that may be available near the business park. Staff reviewed the past history of rate increases, bond terms, etc. with the Council. The Council discussed tabling this matter to allow time for staff to review and respond to the concerns discussed and make recommendations.
Councilwoman Lindstrom made a motion to table Resolution No. 2007-23 for two weeks to allow staff time to make further recommendations to the Council. The motion was seconded by Councilman Gutke and passed by unanimous vote (5-0).
AMENDMENT OF TITLE 5, REVENUE AND FINANCE, OF THE CENTERVILLE MUNICIPAL CODE – ORDINANCE No. 2007-19
Steve Thacker, City Manager, explained that staff has been working on updating the City’s Municipal Code. Titles 1 through 4 were updated and adopted earlier in 2007. The Council reviewed the proposed update of Title 5. Lisa Romney, City Attorney, reviewed the proposed changes and responded to questions from the Council. Local government finance in Utah is highly regulated by State law. Therefore, the substantive content of Title 5 is dictated by the “Uniform Fiscal Procedures Act for Utah Cities” and the “Uniform Accounting Manual for Utah Cities” issued by the State Auditor’s Office. Staff noted that none of the taxes currently levied by Centerville City would be altered by the adoption of Ordinance No. 2007-19.
Councilman Gutke made a motion to adopt Ordinance No. 2007-19 revising and recodifiying Title 5 of the Centerville City Municipal Code regarding revenue and finance with the suggested revisions. The motion was seconded by Councilwoman Lindstrom and passed by unanimous vote (5-0).
PUBLIC HEARING RE: ZONE MAP AMENDMENT TO CONSIDER CHANGES TO THE CITY’S ZONING MAP FOR SEVERAL PROPERTIES LOCATED IN THE WEST CENTERVILLE GATEWAY DISTRICT AREA (PARRISH LANE AND 1250 WEST) – ORDINANCE No. 2007-18
Cory Snyder, Community Development Director, stated that the Planning Commission at their November 14, 2007 meeting unanimously recommended approval of the Zone Map amendment to the City Council, with some revisions. Mr. Snyder reviewed the various land parcels 1 through 18 that make up the area in question (Parrish Lane and 1250 West). The owner of parcel 11 may be purchasing parcels 9 and 10 from UDOT, and parcel 11 may also be affected by the sale. He asked the Council to accept the Planning Commission’s recommendations, hold a public hearing, and table the matter until the property owners have a chance to complete the transaction related to the parcels in question.
At 8:00 p.m. Mayor Russell opened the public hearing, seeing no one wishing to comment, he closed the public hearing.
Mr. Snyder responded to questions from the Council regarding building size requirements for a Commercial Very High (C-VH) Zone in the West Centerville Gateway District Area. He stated there are some safety nets in place that would limit building size for this area.
Councilman Allen made a motion to table action on land parcels 9, 10, and 11 located in the West Centerville Gateway District Area to the first City Council meeting in February. The motion was seconded by Councilman Cutler and passed by unanimous roll-call vote (5-0).
Councilman Allen made a motion to adopt Ordinance No. 2007-18 amending the existing Centerville City Zoning Map and Zoning Ordinance of Centerville, Utah affecting various properties located in West Centerville Gateway District Area (Parrish Lane and 1250 West) of the West Side Plan, noting that land parcels 14 and 15 are excluded, parcels 1-8 and 12-13 are rezoned to Commercial-Very High (C-VH) and land parcels 16-18 will be rezoned to Agricultural-Low (A-L). The motion was seconded by Councilman Cutler and passed by unanimous roll-call vote (5-0). This motion was based on the following Planning Commission findings:
1. The proposed Zoning Map amendments meet the criteria found in Section 12-21-080(e) of the Zoning Ordinance, as described in the Staff Report of November 14, 2007.
2. The proposed Zoning Map amendments are consistent with the goals and objectives of the Centerville City Plan, as addressed in the Staff Report of November 14, 2007.
ORDINANCE No. 2007-20 IMPOSING A RAP TAX
The Council reviewed Ordinance No. 2007-20 imposing a one-tenth of one percent (0.10%) RAP tax within Centerville City. Lisa Romney, City Attorney, noted some minor revisions to the ordinance as suggested by the Council.
Councilman Dellastatious made a motion to adopt Ordinance No. 2007-20 imposing a one-tenth of one percent (0.10%) local sales and use tax on taxable transactions within Centerville City to fund a performing arts center and other recreational and cultural facilities and organizations (“RAP Tax”) and adopting Chapter 9, Title 5 of the Centerville City Municipal Code providing for the imposition, collection and distribution of the RAP Tax. The motion was seconded by Councilman Gutke and passed by unanimous roll-call vote (5-0).
DISCUSS PARTICIPATION IN UTAH LEAGUE OF CITIES AND TOWNS “MAKING LIFE BETTER” CAMPAIGN
Blaine Lutz, Finance Director, shared information he received on the cost and availability of promotional items for the Making Life Better campaign. This campaign is being supported by the Utah League of Cities and Towns (ULCT) to make residents aware of services provided by cities. The Council reviewed various logo styles from the ULCT. Most of the departments within the City have budgets for small items, i.e., shirts, letterhead, etc. Mr. Lutz suggested a larger budget expenditure for window and vehicle decals and possibly small signs.
Councilman Allen made a motion to authorize up to $3,000 out of the Contingency
Budget for window and vehicle decals and possibly small signs with the Making Life Better logo. The motion was seconded by Councilwoman Lindstrom and passed by unanimous vote (5-0).
MAYOR’S REPORT
Mayor Russell would like to have a retreat/goal setting meeting with new Council members early next year.
Mayor Russell asked the Council to submit recommendations for individuals who would be willing to fill vacancies on the Planning Commission and Trails Committee.
CITY MANAGER’S REPORT
Steve Thacker, reminded the Council of the Christmas party on December 11th and asked them to R.S.V.P. if they haven’t already done so.
The Council agreed to meet with local Legislators on January 15th prior to the City Council meeting to discuss various issues for the upcoming Legislative session.
The Council agreed to meet with the Whitaker Museum Board on December 18th prior to the regular City Council meeting.
There will be a swearing-in-ceremony for newly elected officials on January 2nd prior to the City Council meeting.
MISCELLANEOUS BUSINESS
Steve Thacker, City Manager, asked the Council to review proposed legislation that would modify the Justice Court and give feedback. One of the proposed modifications would require cities to have or share a full-time judge. This would not allow for part-time judges in the Justice Court. Centerville currently has a well qualified part-time Judge who would be affected by this proposed legislation if it is adopted. The Council did not disagree with legislation that would mandate certain qualifications for judges, but would want to preserve the option for qualified judges with part-time status.
Mayor Russell updated the Council regarding potential legislation related to waste management.
Councilman Cutler suggested looking to the group at Rodger’s Memorial Theatre to provide sound equipment and/or entertainment for the park entertainment series.
The Council discussed looking into hiring an outside party to tabulate the community survey results.
At 9:15 p.m. the Council took a short break.
At 9:20 p.m. the Council adjourned the regular meeting and went into a meeting of the RDA Board.
