Minutes of the Special City Council meeting held Thursday, October 23, 2008 at 8:30 p.m. in the Centerville City Council Chambers, 250 North Main Street, Centerville, Utah.

PINEAE VILLAGE PUD, CONDO PLAT III

Cory Snyder, Community Development Director, explained this special City Council meeting is for the final subdivision approval for both Phases 5 and 6 of the Pineae Village Development. These two phases consist of five condominium buildings and one town home building. The Planning Commission has reviewed it, and all of the site plan approvals have been given. Mr. Snyder said the plat portion of the project is being recorded so that some of the units can be purchased.

Staff recommends approval of the project, subject to any needed plat notes required by the City Engineer, City Attorney, and Community Development Director, and making sure all the addresses are correct.          

Mayor Russell opened the public hearing for comments.

Tess Peterson, applicant, Gold Medallion Homes, expressed appreciation for the special session to have this project approved.

Mayor Russell closed the public comment portion of the public hearing.

Councilwoman Lindstrom made a motion to recommend approval of the final subdivision plan and plat for Phases 5 and 6 of the Pineae Village Planned Unit Development, based on the following conditions:

1. All professional service fees shall be paid.
2. The applicant shall record the approved plat for Phases 5 and 6 with the Davis County Recorder’s Office.
3. All previous conditions from the final site plan, development agreement and phase amendments shall remain in effect.
4. The applicant shall resubmit a final plat with the correct addressing, to be reviewed by staff, before the plat shall be signed and recorded.
5. The water meters for building 217 shall not be located within the driveway or driveway strip.  All water meters for building 217 shall be verified by City staff before construction is to begin.
6. Staff will do all finalization checks before the plat is recorded.

Findings:

1. The applicant has submitted a complete application for a final plat application [Section 15-4-102].
2. The applicant has received previous conceptual subdivision acceptance and preliminary subdivision approval prior to submitting an application for a final subdivision approval. [Chapters 15-2; 15-3; 15-4].
3. All the required information to be shown on the final plat has been indicated on the plans [Section 15-4-103].
4. All previous conditions of approval have been satisfied [preliminary subdivision, August 24, 2005, amendment to Phase 5, November 20, 2007, Development, and March, 2006].

Councilman Allen seconded the motion, which was passed by unanimous roll-call vote (5-0).

At 8:45 p.m., Councilwoman Lindstrom made a motion to adjourn the meeting.  Councilman Allen seconded the motion, which was passed by unanimous roll-call vote (5-0).
