Subject: City Manager’s Summary of April 21, 2009 Council Meeting
Date:  April 17, 2009

We begin Tuesday evening with the regular Council meeting at 7:00 p.m.  There is no work session or ACB/RDA meeting prior to the regular meeting.

D. Commendations -The Mayor will recognize Stephanie Wheatley for her service on the Trails Committee, including a good portion of her three-year term as the Committee Chair.  The Trails Committee accomplished a great deal under her leadership, including the production of a City Trails Map, adoption of a Trails logo, installation of several trail kiosks and improvement of the Ford Canyon Trail.

F.1. Minutes – The minutes to be approved are enclosed.

F.2.  Summary Action Calendar
a. Animal Control Ordinance – Davis County has asked each of the cities participating in the County’s animal control program to adopt an animal control ordinance similar to that which has been adopted by the County.
b. Purchase of Pickup Truck – Although not funded in the current budget, this purchase can be funded in the manner proposed in the enclosed staff report – i.e., the combination of revenues from the sale of two other vehicles plus savings from one or more line items in the Water Fund budget.

F.3. Grant application for police equipment – Some of the federal stimulus money is flowing to police departments in Utah via the Edward Byrne Memorial Justice Assistance Grant program.  The City of Layton is administering this joint grant application for the law enforcement agencies in Davis County.  The grant process requires the opportunity for public comment on the proposed use of funds.  Centerville is receiving approximately $12,000.
 
F.4. Davis Cultural Arts Center – In an earlier meeting, the City Council approved a resolution expressing their intent to issue sales tax revenue bonds for the Cultural Arts Center project.  That resolution also established a public hearing date of April 21 to receive public comment on that proposal.  Although the Council will conduct the public hearing on April 21, the final bond resolution will not be considered until the May 5 Council meeting.  The agenda shows the potential for issuing up to $16 million in bonds,  but the likely amount will be approximately $12 million, depending on the decision of the City Council.  That $12 million plus approximately $2 million in cash on hand would provide the approximately $14 million needed for this project.  Although the City sales tax revenues would be pledged to secure repayment of the bonds, the Council’s intent is for the bonds to actually be repaid from the following three revenue sources:  1) RAP taxes from Centerville and Bountiful; 2) RDA tax increment; and 3) Davis County Tourism Fund contributions.

F.5. Award bid for City Hall addition/remodeling project – Bids from 15 contractors were opened on April 8 for this project.  Brubaker Construction’s low bid of $591,600 was substantially below the architect’s estimate.  I recommend the Council proceed with all phases of the project, including relocation of the IT equipment to the basement level.  With the addition of a project contingency, architect and engineering fees, purchase of furniture and relocation of the IT equipment, the total budget being requested by staff is $756,600, with $21,000 coming from the Water Fund and $735,600 from the Capital Projects Fund.  The Capital Projects Fund has a total of $803,635 for this project.

F. 6. City Website – Blaine Lutz will report on the progress of developing the City’s new website.  Mayor Russell is also asking the Council to consider participating in the Community Video Showcase Program, which is promoted by the National League of Cities.  This would involve an agreement with a company that produces streaming video of the community to be incorporated in the City’s website, the cost of which is covered by on-line advertising connected with the streaming video.

F. 7. Mayor’s Report – I presume the Mayor will report on a few matters.

E. 8. City Manager’s Report – I will report on preparations for the April 28 hillside field trip and seek some direction from the Council regarding the itinerary.  I will also update the Council on the proposed improvements for the Parrish Lane/400 West intersection, involving the Dairy Queen and America First Credit Union property owners.

F.9. Presentation from Justice Judge Miller – Centerville Justice Court Judge David Miller has asked for some time to make a presentation regarding the impact of the 2008 State legislation on Justice Court operations and on the salary of justice court judges.  This topic is scheduled for 8:30 on the agenda at the request of Judge Miller, who has earlier commitments.
 
F. 10. Miscellaneous Business
a. Quarterly Financial Report – Blaine Lutz prepared the enclosed report for the nine-month period ending March 31, 2009.  He will answer questions at the meeting.
b. Legacy Parkway Trail maintenance – I will report on the status of this subject.
c. Legislative Policy Committee applications – The Utah League of Cities and Towns has requested nominations for membership on the Legislative Policy Committee for the coming year.  As was the case last year, they are allowing each city to appoint up to three representatives, as explained on their enclosed form.

F.11. Well-site purchase agreement – Over the past year staff have negotiated an agreement for the purchase of a well site located near the intersection of Main Street and Chase Lane.  The only remaining issue is the amount of compensation for the property.  I recommend the Council go into a closed session as allowed by item no. 12 on the agenda, to discuss what the Council is willing to pay for this property.  I will ask Randy Randall to be present for that discussion.

F.12. Closed meeting – As mentioned above, I recommend a closed meeting.

F.13. Possible action following closed meeting – There may be a need for action in open meeting relating to the discussions in the closed meeting.

9:15 RDA Meeting – In addition to the approval of minutes, there is only one business item showing on the RDA Agenda – the discussion of a proposal for a second building on the island parcel.  The property owners have asked the RDA for the possibility of allowing retail business in lieu of a second restaurant on the north end of that parcel.
