Minutes of the Centerville City Council meeting held Wednesday, September 16, 2009 at 7:00 p.m. in the Centerville City Council Chambers, 250 North Main, Centerville, Utah.

PLEDGE OF ALLEGIANCE

INVOCATION  Blaine Lutz, Asst. City Manager/Finance Director

COMMENDATIONS

Steve Thacker, City Manager, presented Blaine Lutz, Assistant City Manager/Finance Director, with a Certificate of Achievement for Excellence in Financial Reporting. The Government Finance Officers Association recognizes state and county governments that go above and beyond the normal requirements of the law in preparing financial reports and disclosing financial information to the public. Centerville has received this award for the past nine years, which represents a significant effort by Mr. Lutz and his staff. Mr. Lutz said this award represents the work of the Finance Department, and in particular, Jeannine Teel in connection with the annual audit.

OPEN SESSION

There was no one wishing to comment.

MINUTES REVIEW AND ACCEPTANCE

Minutes of the September 1, 2009 City Council work session were reviewed. Councilman Wright made a motion to approve the minutes as written. Councilman Averett seconded the motion, which was approved by unanimous vote (4-0).

Minutes of the September 1, 2009 joint City Council/Youth City Council meeting were reviewed. Councilman Wright made a motion to approve the minutes as written.  Councilman Averett seconded the motion, which was passed by unanimous vote (4-0).         

REPORT REGARDING WHITAKER MUSEUM DEMOLITION AND RESTORATION ACTIVITIES

Paul Smith, Whitaker Museum Board Chair, reported on the demolition and renovation work that is taking place at the Whitaker Museum, and the City Council viewed slides of the renovation that is taking place. Councilman Wright reported the next phase of renovation work will be the gathering room. Melissa Hogan reported the bid for the Gathering Room conversion is $16,550, and there is sufficient funding for the demolition and reconstruction.

Councilman Wright made a motion to give the Whitaker Museum Board permission to proceed with demolition of the Gathering Room at the Whitaker Museum, and to repair the wall and roof if sufficient funds are available. Councilman Averett seconded the motion.  Councilman Cutler praised the Whitaker Museum Board for their work at the Museum. Cory Snyder, Community Development Director, said demolition and construction permits will need to be issued. The motion was passed by unanimous vote (4-0).

Councilman Wright commended Melissa Hogan and members of the Whitaker Museum Board and the docents for their work at the Whitaker Museum.

FINANCIAL REPORTS

a. FY 2008-2009 unaudited report
Blaine Lutz reported there are concerns with the economy which impact the sales tax heavily. Ninety-two percent of budgeted revenues were received for FY 2008-2009. Councilman Wright asked if UTOPIA has given any indication of when they will begin to draw upon the cities pledges and how Centerville would replenish its pledge. Mr. Lutz said the money would come out of the Capital Projects Fund.  Councilman Wright asked that a report be given from UTOPIA on when they will begin their work in Centerville.  Mayor Russell asked the status of revenues being used to repay the Davis Cultural Arts Center bonds.  Mr. Lutz explained the bond repayment revenues are doing okay.

b. Year-to-date report
Blaine Lutz reported sales tax revenues were low at the beginning of the current fiscal year. State and local sales tax in general are down 15 percent from past years. 

MAYOR’S REPORT

Mayor Russell had nothing to report.

CITY MANAGER’S REPORT

a. Jennings Lane Subdrain
Steve Thacker, City Manager, reported the City is still trying to get the property owners to sign subdrain easements, and there will be a meeting on October 27th with the residents. The road has been rebuilt. The hope is that residents will agree to sign the easements which restrict the planting of certain types of trees and plants that would obstruct the subdrain.

b. October 31, 2009 Community Emergency Response Exercise
Table top exercise will be held on October 15th with staff and other agencies represented to discuss the disaster scenario for the October 31st Community Emergency Response Exercise.

c. New Date for Historic Preservation Work Session
  Historic Preservation Work Session is scheduled for October 20, 2009.

d. Dates for Volunteer Recognition Dinner and Employee Christmas Dinner
Volunteer Recognition Dinner will be held on November 9th at 7:00 p.m. at Fire House Pizza. Christmas employee dinner is preferred to be on December 8th, with December 2nd as a back-up date.

MISCELLANEOUS BUSINESS

a. Primary Election Canvass – September 22nd at 7:45 a.m.
Justin Allen, Lawrence Wright, and Ken Averett said they could meet to canvass the results of the primary election on September 22nd at 7:45 a.m.

b. Accept public utility easements from Matt and Emily Brooke Johnson
Councilman Cutler made a motion to accept the public utility easement from Matt and Emily Brooke Johnson in connection with the Planning Commission’s approval of their small subdivision waiver. Councilman Averett seconded the motion, which was passed by unanimous vote (4-0).

CLOSED MEETING

At 8:15 p.m., Councilman Allen made a motion to adjourn for a closed meeting for the purpose of discussing the character and competency of an individual.  Councilman Wright seconded the motion, which was passed by unanimous vote (4-0).

RETURN TO OPEN MEETING

At 8:45 p.m., the City Council returned to an open meeting.

ADJOURN TO RDA MEETING

At 8:45 p.m., Councilman Wright made a motion to adjourn to an RDA meeting. Councilman Allen seconded the motion, which was passed by unanimous vote (4-0).   

RETURN TO CITY COUNCIL MEETING

At 9:38 pm., the City Council returned to their regular meeting.

MISCELLANEOUS

The Council discussed that Best Buy Auto has changed ownership. The new owners will be sent a warning for violating the conditional use permit.           

Councilman Wright said he met with Bruce and Nancy Smith regarding the Main Street redevelopment plan.  The Smiths are under the assumption that a UTA Park and Ride is going to be constructed near 100 North.  Steve Thacker explained the Main Street Plan supports the idea of shared parking in places along Main Street, but no specific places have been identified at this time; it is only a concept. Mayor Russell explained the process going on at this time is the Environmental Impact Study process, not the decision of where parking lots would be located.  A letter was sent to the consultant doing the study indicating the City’s preference for a Main Street route, but not to widen the right-of-way. It is anticipated there may be some widening of Main Street in certain areas, but generally the right-of-way should not be widened. There will be a period this fall where public comment will be taken on the preferred alternative before the environmental report is finalized. 

ADJOURNMENT

At 9:50 p.m., Councilman Cutler made a motion to adjourn.  Councilman Allen seconded the motion, which was passed by unanimous vote (4-0).
