Minutes of the Centerville City Council meeting held Tuesday, October 6, 2009 at 7:00 p.m. in the Centerville City Council Chambers, 250 North Main, Centerville, Utah.

MINUTES REVIEW AND ACCEPTANCE
The minutes of the September 16, 2009 Council meeting were reviewed and amended. Councilman Cutler made a motion to approve the minutes as amended. The motion was seconded by Councilman Wright and passed by unanimous vote (5-0).

The minutes of the September 22, 2009 meeting of the Board of Canvassers were reviewed. Councilman Cutler made a motion to approve the minutes. The motion was seconded by Councilman Wright and passed by unanimous vote (5-0).
SUMMARY ACTION CALENDAR
The Council reviewed items a and b on the Summary Action Calendar. The Council agreed to discuss item b in more detail.
a. Approve joint funding agreement for FY 2010 with U.S. Geological Survey in the amount of $4,100 for maintenance of stream gage on Centerville Deuel Creek.
Councilman Cutler made a motion to approve item a on the Summary Action Calendar. The motion was seconded by Councilwoman Lindstrom and passed by unanimous vote (5-0).
b. Approval to purchase a 2010 Ford Explorer from Willey Ford in the amount of $26,147 for the Police Department.
Steve Thacker, City Manager, responded to questions from the Council regarding the bidding process for police vehicles. Councilman Wright made a motion to approve item b on the Summary Action Calendar. The motion was seconded by Councilwoman Lindstrom and passed by unanimous vote (5-0).
EMERGENCY MANAGEMENT
a. Presentation regarding integration of the Neighborhood Network into the Citizen Corps program by Councilman Lawrence Wright.
Councilman Wright reviewed the background of the Citizen Corps as well as the more recent integration of the Neighborhood Network. He also explained the role and objectives of the Citizen Corps as well as the staffing structure. A few of the goals of the Citizen Corps are to support the City during emergencies and help strengthen the Neighborhood Network. In the past, LDS Church buildings have been used as primary venues for District command posts. The Citizen Corps is currently shifting to designated City facilities as primary command posts and obtaining permission from the LDS Church to use their facilities as a contingency or secondary venue/command post.
b. Briefing regarding the October 31 community exercise by Lieutenant Child.
Lieutenant Child, Emergency Management Director, provided the Council with a binder containing the details of the community exercise planned for October 31, 2009. The exercise will be a simulated debris flow from Centerville Canyon. A mobile command post will be set up at Island View Park and the Emergency Operation Center (EOC) will be at City Hall for the simulation. Lieutenant Child reviewed a detailed script and concept of operations that will be followed for the exercise. He responded to questions from the Council and members of the audience.
GRANT CONTRACT IN THE AMOUNT OF $9,900 WITH THE UTAH DEPARTMENT OF COMMUNITY AND CULTURE AND ACCOMPANYING PRESERVATON AGREEMENT WITH THE UTAH STATE HISTORIC PRESERVATION OFFICE
Mayor Russell explained that the City has been awarded a CLG grant (Certified Local Government) funded by the National Park Service and administered by the Utah State Department of Community and Culture. It has been the past practice to have the City Council approve all contractual grants that include matching funds and contractual restrictions. One requirement is that the City, as owner, approve a Preservation Agreement. The Council was provided with the contract and Preservation Agreement. The agreement commits the owner (the City) to 1) assume maintenance and repair for 5 years and 2) no visual or structural alterations will be made to the property without written permission of the Grantee. (State of Utah). The grant is for matching funds of 50% of costs for construction up to $9,900. The Contract has terms and conditions that will need to be followed in the administration of this project. The City’s match may be in-kind and cash, but at least 50% of the match ($4,950) must be in cash.
Councilwoman Lindstrom made a motion to accept the matching grant from the Utah Department of Community and Culture and authorize the Mayor to sign the Preservation Agreement with the Utah State Historic Preservation Office as reviewed by staff. The motion was seconded by Councilman Wright and passed by unanimous roll-call vote (5-0).
The Council asked for clarification regarding the status of the roofing project, exterior finishes and how much is needed to complete the roof and the reconstruction of the Gathering Room. Melissa Hogan, Whitaker Museum Director, updated the Council on the status of the roof repairs to the museum. She explained that there was a problem with the State-approved contractor for the roof and that there are still some roofing issues that need to be done before winter sets in. The Council asked Ms. Hogan to prepare an itemized list of available funding (including donations) and an itemization of the Gathering Room reconstruction costs. The Council believes the receipt of these two documents is crucial before work begins on the Gathering Room phase.
Councilman Wright made a motion to approve up to $7,000 out of Council Contingency to complete the funding of the Gathering Room reconstruction phase, which would include completion of the roof and re-bricking the east exterior wall. The motion was seconded by Councilman Averett and passed by a unanimous roll-call vote (5-0).
At 8:35 p.m. the Council took a ten-minute break.
MAYOR'S REPORT
Mayor Russell reported the Wasatch Integrated Waste Management District has secured land in North Salt Lake for a future solid waste transfer station and a possible recycling center.
CITY MANAGER'S REPORT
Steve Thacker, City Manager, explained that the firearms issue will be on the next Council agenda. A letter from Mr. Nessen and other documents will be included in the packet prior to the meeting.
Mr. Thacker reported to the Council regarding the Silver Oaks Subdivision weed control issues. He continues to be frustrated with the developer’s lack of a written response to Thacker’s August 17 letter. The Army Corps of Engineers has been involved because of an existing stream channel on the property. They are working on a long-term development plan for this area that will address wetland issues.
Mr. Thacker has finally made contact with the developer of the property to discuss the weed control problem that currently exists on the site. The developer stated that the area has recently been sprayed for noxious weeds. The City Manager was given the name of the agent who completed this work, but has not been able to verify that this work has actually been done.
Mr. Thacker and the Council agreed to get verification of the weed abatement. If sufficient proof of weed abatement cannot be secured, the City Manager will send a ten-day notice letter asking the developer to come into compliance and allow him to use some of the interest money from his cash bond to aide in the resolution of this problem.
MISCELLANEOUS
Councilman Wright explained he has been approached by a local resident who is a master gardener about creating an heirloom garden behind the Whitaker Museum. The Council suggested the Parks and Recreation Committee should review this request since the Recreation Coordinator has already been allowing residents to use this area for a garden. The City Manager will report back to the City Council on this matter.
