Subject: City Manager’s Summary of December 1, 2009 Council Meeting

5:45 Historic Preservation Work Session -- The City Council will begin early next Tuesday evening with a 5:45 work session re: historic preservation. The City Council agreed several months ago to hold a work session on this topic, but scheduling it sooner was not feasible due to the presenter’s availability and the Council’s other work sessions and special meetings. The purpose of this work session is to educate the Council regarding the various levels of a historic preservation program that a city could support. Fred Aegerter, currently Springville City’s Community Development Director, will be the main presenter. He has significant experience in municipal historic preservation programs, including experience with the City of Ogden. Cory Snyder, Centerville’s Community Development Director, will explain the City’s current program for historic preservation. The City Council can then discuss whether they want to stay with the current program or move in another direction. There are no advance materials for this work session. Please note that dinner will be available at 5:30 p.m. for the work session participants

E.1. Minutes Review and Acceptance – The minutes to be approved are enclosed.
E.2. Summary Action Calendar
a. Interlocal Agreement – Staff recommend the City enter into an agreement with Davis County to share the cost of engineering services for the replacement of the Parrish Creek Culvert under 1250 West. The County Public Works Director has stated it is his intent for the County to fund the actual replacement of the culvert, although he cannot make that absolute commitment at this time.
b. Terminate Warranty Period – RB’s One Stop is ready for termination of its warranty period.
c. Personnel Policies Amendment – A 2008 federal law pertaining to the use of genetic information is the reason for this amendment to the City’s Personnel Policies and Procedures. The amendment would prohibit discriminatory employment practices based on genetic information.
E.3. Centerville Minutes Policy – Recent State legislation requires that each Utah city adopt a policy pertaining to the approval of the minutes of the City’s various bodies, including how soon a draft of the minutes will be available to the public. The policy proposed by staff is enclosed under Tab 3.b. of the notebook. Adoption of this policy would also require amendments to the Zoning Ordinance (Title 12) and Municipal Code (Title 2). Since amendments to Title 12 require a public hearing, the Council will first need to conduct a public hearing on the proposed amendments to Title 12 before adopting Resolution No. 2009-27 approving the Minutes Policy. That action would then be followed by approval of two ordinances—one pertaining to Title 12 and the other to Title 2 of the Municipal Code.
E.4. Public Hearing – General Plan and Zoning Code Amendments Affecting West Side – U.S. Development has submitted applications for a General Plan amendment and Zoning Code amendments relating to their proposed commercial/residential project west of I-15 on the south side of Parrish Lane. The proposed project is a mixed-use development consisting of a 14-screen movie theater complex, other entertainment facilities, retail businesses and approximately 250 apartments. The current General Plan section pertaining to the area west of I-15 allows for the possibility of a mixed-use commercial/residential development further north, but not in the area proposed by U. S. Development. The City’s planned commercial center ordinance also does not currently allow for a residential component in a planned commercial center. Therefore, the developer has applied for both an amendment to the General Plan and amendments to the Zoning Code. The Planning Commission has recommended approval of these amendments and has also accepted a conceptual site plan for this project, conditioned upon the City Council’s approval of these amendments and a number of other conditions placed upon the project by the Planning Commission.
E.5. Zoning Code Amendments re: Artificial Landscaping – This is a continuation of a matter the Council has dealt with in several earlier meetings. The Council recently approved amendments to the Zoning Code pertaining to the use of artificial landscaping. However, they directed staff to draft additional amendments that would create some differences in the allowances for artificial landscaping in the various commercial districts of the city. Those additional amendments as drafted by staff were discussed recently by the Planning Commission; however, the Planning Commission could not agree on this matter. Therefore, it is coming to the City Council without a recommendation from the Planning Commission.
E.6. Deuel Creek Channel Flood Control Project – A year ago the City Council approved an interlocal agreement with Davis County in which the City agreed to pay 25 percent of the cost of the design of four projects involving the Deuel Creek Channel. The City has an opportunity to submit a federal grant application which would, if awarded, fund 75 percent of one of these projects. The grant application is due December 4; therefore, the City Council needs to discuss the potential funding sources for these various projects and decide whether to authorize the grant application and commit the local match for this first project. The first project would involve the replacement and enlargement of the Deuel Creek Channel west of I-15. The City Engineer will attend the Council meeting to explain the scope of these projects and answer questions.
E.7. Mayor’s Report – I assume the Mayor will report on a few matters.
E.8. City Manager’s Report –
a. Main and Parrish Intersection Project – The improvement of this intersection was put on the State’s five-year plan just a few years ago. Due to federal stimulus funds, however, many projects in the first couple of years of that plan have now been funded and the City’s project has moved up for construction during Federal Fiscal Year 2010-11. This means design of this project needs to begin right away. I will explain the scope of this project at the meeting and request the Council’s support for the City Engineer to proceed with initial surveying and environmental work.
b. 400 West Traffic Study Update – I will report on the status of this traffic study and may request additional funding.
c. Website Report – Blaine Lutz will report on the status of this project.
d. Cemetery Expansion – This matter is scheduled to come back to the Council at their December 15 meeting; however, I may need some interim direction regarding the Council’s desire for public comment on this matter.
E.9. Miscellaneous Business – At this time I do not know of any topics to identify under “Miscellaneous Business.”
E.10. Closed Meeting, if necessary – At this time I do not know of the need for a closed meeting.
9:15 RDA Meeting – In connection with item No. 4 on the City Council agenda, the RDA Board should meet (following the regular Council meeting) to discuss U. S. Development’s request for financial assistance relating to the Legacy Crossing Project. Staff has made no commitments to the developer regarding financial assistance at this point, but has had a couple of discussions about the possibility of creating a Community Development Area under the RDA laws. The RDA Board should be brought up to speed on this matter and give staff direction regarding any further consideration of this request. There are no advance materials in the notebook on this topic.
