Press Release: Firearm discharge

Centerville Police responded yesterday to a report of a shot fired in the restroom of the Carl’s Jr. at 385 North 800 west in Centerville. Officers discovered that a gun had accidently gone off in the bathroom after being dropped on the floor. A 26 year old man was in the bathroom using the toilet and was carrying a 40 caliber "Khar P40" auto handgun in an "inside the pants" holster. The man had a valid concealed weapon permit issued by the State of Utah and was lawfully in possession of the gun.

While pulling his pants up the gun fell out of the holster, striking the tile floor. When the gun hit the floor it went off and the bullet struck the toilet, shattering it and sending sharp pieces of porcelain flying. The man was hit in the arm by some of the porcelain causing some small lacerations. South Davis Metro Fire Ambulance responded and treated the man’s injuries at the scene. He was not transported.

There were no other injuries, however, a female employee in the adjacent women’s bathroom heard the gun shot and was frightened. South Davis medical personnel checked her as she was experiencing chest pain, and she too was released on scene.

In this case it appears that the accident would have been prevented if the man had used a secure holster. A good quality firearm also should not fire if it is dropped. No charges were brought against the man but the firearm was taken for safe keeping.
